Collaboration with neighboring allocated land and taking advantage of a ransom position

25 acres of land within an allocated area for development that became crucial to the success of the whole scheme 

Acting for the landowner Chesters Harcourt successfully:

  • Negotiated enhanced terms for the sale of the land to reflect the importance of the particular parcel to a much larger and allocated scheme. Dealing with the neighbour and promoter to create a ‘landowners agreement’ that would work for obtaining the consent and any subsequent disposal.
  • Planning permission was obtained at nil cost to the landowner. The local community objecting to the scheme (albeit on land that was already allocated) caused a one year delay whilst the permissions were ‘Judicially Reviewed’ by an independent Court. With no case to answer the combined property was placed in a national market during Covid period. Resulting in all bidding and contracts being carried out on-line and a sale to a consortium of house builders. The scheme maximized the value of the combined land to include 720 houses, a school and employment land and a wide swathe of landscaping.
  • The whole scheme sold in excess of £25m involved Chesters Harcourt representing the best interests of a minority landowner to achieve a cash sum and 15 acres retained with the benefit of planning permission and access – all at nil cost to the landowner.
